DATE : 21/10/2021 Civil Application No. 1988/21 is for withdrawal of the amount of compensation by Respondent No.1/claimant.

Since the appeal filed by the appellant/MIDC bearing First Appeal No. 729/2008 has been dismissed on 13.09.2019, there cannot be any impediment for the original claimant to withdraw the amount of compensation as deposited in this court along with accrued interest, if any.

Mr. Chakrawarty, learned counsel h/f Mr. M.M Agnihotri, learned counsel for the appellant also has no objection.

caf1988.21.odt Considering the above position, Civil Application is allowed. The amount of compensation deposited in this Court as per order dated 09.09.2008 along with accrued interest thereupon be paid over to the respondent No.1/original claimant.
