Heard Shri C. G. Barapatre, learned counsel for the petitioner.

Shri V. A. Thakare, learned Additional Public Prosecutor for the respondents/State submitted that State has filed reply and in paragraph No.3 of the said reply it is stated that in view of expert's opinion the Investigating Agency has prepared 'B' final report.

The learned Court before which the said 'B' final report will be filed, shall not accept the same unless and until the petitioner who is the complainant is heard. After hearing the learned counsel for the petitioner, it will be open for the learned Magistrate either to accept or reject the 'B' final report.

With this observations, writ petition is disposed of.
