In a suit for declaration and permanent injunction the application Exh.5 moved by the plaintiff for temporary injunction was granted in favour of the plaintiff vide impugned judgment and order dated 20/07/2022.

The suit property involved in the present matter is an open land.

This Court on 14/09/2022 directed the parties to maintain status quo and since then the same is in operation.

Today, both the parties requested for direction to the learned trial Court to expedite the trial by continuing the order dated 14/09/2022.

Considering the joint request and the fact that the order dated 14/09/2022 is in operation since long, to meet the ends of justice, it would be appropriate to pass following order:

i) The trial Court is directed to expedite the matter and decide it within one year from today. ii) The order dated 14/09/2022 directing the parties to maintain status quo shall continue till decision in the suit.

iii) The parties undertake to cooperate the trial Court to decide the suit within the stipulated period.

The Writ Petition is disposed of accordingly. No order as to costs.
