Applicant is arrested on 9th June, 2017 in connection with crime registered against 11 accused (including the applicant) on the accusations that the accused have sexually assaulted the victim, who is mentally challenged and is aged about 16 years. The applicant, aged about 70 years, claims that at the relevant time he was working as Guard at the site of construction alongwith another Guard Suresh Bharsakle (co-accused) that the applicant is implicated only because he was employed as a Guard at the construction site and according to the investigating agency, the applicant has provided room / space to the co-accused, where the crime is committed.

The non-applicant has not been able to point out that custody of the applicant is required for further

Considering the facts on the record and nature of accusations against the applicant, following order is passed:

The applicant having been arrested in connection with Crime No.153/2017 registered by the non-applicant, he be released on bail on executing P.R. bond for Rs.20,000/- (Rs. Twenty Thousand) and furnishing one solvent surety in the like amount. The application is allowed accordingly.
