By this Criminal Writ Petition, the petitioner challenges the order of the D.I.G. (Prisons), Nagpur and seeks his release on furlough leave.
The prayer made by the petitioner cannot be granted as the petitioner is convicted for the offence of rape and in view of the amended provisions of Rule 4(13) of the Prisons (Bombay Furlough and Parole) Rules, 1959, a convict who is sentenced for the offence of rape would not be entitled to furlough leave.
In the result, we dismiss the Criminal Writ Petition with no order as to costs.
