Since the petitioner has sought a limited relief of directing the learned Civil Judge, Senior Division, Akola to decide Land Acquisition Case No. 214/1997, we do not find that the notice to respondent no. 2 would be necessary. As such, the requirement of notice to the said respondent is dispensed with.

Heard Mr. A.A. Naik, learned counsel for the petitioners and Mrs.Rashi Deshpande, learned A.G.P. for respondent no.1 Taking into consideration that the reference is pending from 1997 the petition is disposed of with a direction to the learned Civil Judge, Senior Division, Akola to decide land Acquisition Case No. 214/1997 as expeditiously as
