DATE :- 28thJULY, 2023 The petitioner who is serving on the post of Hostel Superintendent seeks fixation of his pay-scale in accordance with the Government Resolution dated 05.02.2000. By making representation dated 17.07.2021, the petitioner prays that appropriate pay-scale be applied to him in the light of the judgment of this Court at Aurangabad Bench in Writ Petition No. (Dnyanba P.Jatale vs. The State of Maharashtra and others) decided on 25.06.2014. The petitioner's representation is pending with the respondent no.3. 2.

In these facts, issue Rule. Rule made returnable forthwith. Ms N. P. Mehta, learned Assistant Government Pleader waives service of notice for respondents.

The respondent no.3- The Assistant Commissioner Tribal Development Department, Amravati, is directed to consider the representation of the petitioner dated 17.07.2021 and take a decision thereon in accordance with law. The petitioner is free to place additional documents before the respondent no.3 for consideration of the said representation. The decision be taken within a period of eight weeks of receiving copy of this order.
