The applicant is arrested on 23rd June, 2017 in connection with crime registered against him and three others for the offences punishable under Sections 8, 21 and 29 of Narcotic Drugs and Psychotropic Substances Act, 1985. The accusations against the applicant are that 30 small packets of heroin are seized from him.
According to the Investigating Agency, 56 small packets of heroin are seized from co-accused Milind and the total quantity of the heroin seized from these two accused is 6.28 gram.
The application is opposed on the ground that custody of the applicant is required to interrogate him to find out whether any other person is also involved. The learned advocate for the applicant has submitted that the applicant is falsely implicated. It is submitted that father of the applicant is ready to stand surety, if the applicant is released on bail.
2 ba628.17 The applicant, aged about 20 years, claims to be a student and the facts on record show that he is not involved in any other crime/offence.
Considering the facts of the case, following order is passed :
The applicant having been arrested in connection with Crime No.982 of 2017 registered by the non-applicant, he be released on bail on executing P. R. Bond for Rs.50,000/- and furnishing one solvent surety in the like amount.
As Vijay Jagam, father of the applicant, has shown willingness to stand surety for him, it is directed that the solvent surety shall be furnished by Vijay Jagam, father of the applicant.
The application is allowed in the above terms. JUDGE PBP
