Heard Ms Tripathi, learned counsel for the applicant. Shri S.A. Jamkar, learned counsel for the non-applicant is absent.

The application seeks transfer of Hindu Marriage Petition No.133/2018 instituted by the applicant/husband in the Court of Joint Civil Judge Senior Division, Gondia to the Family Court No.4, Nagpur on the ground that the Petition No.A-455/2018 has been instituted by the non-applicant/wife before the Family Court, Nagpur and both are required to be heard together.

Considering the request made by the learned counsel for the applicant, Hindu Marriage Petition No.133/2018 on the file of Joint Civil Judge Senior Division,
2309 MCA 467 of 2021.odt Gondia, instituted by the husband is hereby transferred to the Principal Judge, Family Court, Nagpur to be decided along with Petition No.A-455/2018.

The parties shall appear before the Principal Judge, Family Court, Nagpur on 03/10/2022 through counsel and place a copy of this order before him to apprise him of the same. The parties shall also appear before the Joint Civil Judge Senior Division, Gondia through counsel and place a copy of this order before the learned Court in order to apprise him of the same and so also to enable him to transfer the record to the Principal Judge, Family Court, Nagpur. 5.
In case there is video conferencing facility available with the Principal Judge, Family Court, Nagpur any application filed by the applicant for appearing in the proceedings through video conferencing shall be taken into consideration unless the personal physical presence is desired by the Court.

The Misc. Civil Application is allowed accordingly. No order costs.
