The petitioner, who was working as a confirmed Teacher in Bismilla Khan Urdu Primary School, runs by the respondent No.2, on having zero strength, is praying for declaring him as excess/surplus. Such prayer is opposed on the ground that the petitioner does not posses TET certificate. 3.

Thereupon, the learned counsel for the petitioner submits that the petitioner would give an undertaking to complete TET in next three years and till then the claim of the petitioner to declare the petitioner as surplus and to absorb the petitioner in some other school may be considered by the Zilla Parishad.

Learned counsel for the respondent No.1-Zilla Parishad submits that such request would be considered and decision would be taken on such request if the petitioner approaches to the Zilla Parisahd making a representation in this regard.

Thereupon, Ms Radhika Bajaj, learned counsel for the petitioner submits that within ten days from today, the petitioner would submit the representation making such a request to the Education Officer (Primary), Zilla Parishad, Washim.

Accordingly, we dispose of this writ petition, with direction to the Education Officer (Primary), Zilla Parishad, Washim that if the petitioner submits a representation to the above referred effect within ten days from today, the same shall be considered and decided within three weeks from the date of submission of such representation.
