Since the petitioners have sought a limited relief of directing the learned Civil Judge, Senior Division, Akola to decide Land Acquisition Case Nos. 208, 210, 211, 212, 213, 217, 218, 219, 220, 221 and 222 all of 1997, we do not find that the notice to respondent no.2 would be necessary. As such, the requirement of notice to the said respondent is dispensed with.

Heard Mr. A.A. Naik, learned counsel for the petitioners and Mrs.Rashi Deshpande, learned A.G.P. for respondent no.1 Taking into consideration that petitioner no.1 is suffering from brain tumor and is aged about 75 years, and further that the reference is pending from 1997 the petition is disposed of with a
