By this application, the applicant is seeking condonation of delay of 172 days, which is caused in preferring the appeal. The grounds raised in the application is that, applicant is illiterate and was not aware of the legal provisions. Moreover, he was undergoing the financial crisis and, therefore, could not approach the counsel to prefer the appeal.

Learned APP strongly opposed the said application on the ground that there is no satisfactory reason for condoning the delay.

Considering the reasons mentioned in the application, and being it is a statutory right of the applicant to prefer an appeal. There is satisfactory reason to condone the delay, in view of that, the application is allowed. 4.
Delay in filing the appeal is condoned.

Appeal be registered. On registration of the appeal, notice be issued to the respondent No.2/victim. 6.
The Police Station Officer, Police Station Gangazari, Tah. and District Gondia shall intimate the respondent No.2/ victim.
