DATED : SEPTEMBER 05, 2017 This application is filed by respondent wife for issuing directions to petitioner for making payment of arrears of maintenance of Rs.1,84,000/-.

Shri Mehta, learned Counsel for petitioner, seeks time to file reply.

Sufficient time for filing reply is already granted to petitioner. In spite of that, no reply is filed. On the earlier date, last chance was granted to petitioner to file reply.

Shri Dhandekar, learned Counsel for respondent, submits that petitioner is in arrears of maintenance to the extent of Rs.1,84,000/-.

It is noted that petitioner is directed to pay interim maintenance at the rate of rupees five thousand per month in the proceedings under the Protection of Women from Domestic Violence Act by learned trial Court, which order is upheld in appeal. The application is pending for further consideration.

0509appw128.17 2/2 In the circumstances and having considered the reasons mentioned in the impugned order by appellate Court upholding order of learned trial Court, application is liable to be allowed. Petitioner to make payment of arrears of maintenance to respondent as claimed in the application within three months either in lumpsum or by instalments, which shall not be less than Rs.25,000/- each, as out of total amount of Rs.1,84,000/- claimed by respondent, major amount of Rs.1,20,000/- has not been disputed by petitioner to be in arrears. The application is accordingly disposed of as allowed.
