The three accused, who are the actual assailants in this case, have already been arrested and they are still in Magisterial Custody Remand. So far as this applicant is concerned, the role attributed to him is that of an instigator. One thing is clear from the allegations made in the complaint that this applicant has not been accused of firing any shot from the pistol or actually assaulting the complainant. All these circumstances would show that custodial interrogation of the applicant, at this stage, would not be required. Therefore, this applicant deserves to be released on bail. Hence, the order. The application is allowed and the interim bail granted to the applicant by this Court on 01/8/2016 is hereby confirmed on the same conditions.
