In the morning session, when the matter was called the counsel for the petitioner was absent, therefore in order to give one chance to him the matter was kept passover.

(2) In the afternoon session, when the matter was called out, Shri A.P. Wachasundar, learned counsel was absent. However, Shri H.N. Verma, learned counsel submits that Shri Wachasundar informed him on phone call that he has no instructions in the matter.

(3) It is pertinent to note that Shri A.P. Wachasundar, learned counsel till today has not filed any application for discharge from proceedings on record. Therefore, it was his duty to appear before this Court.
