By this Writ petition, the petitioners seek a direction to the respondents to consider appointing the petitioners and the other employees mentioned in the list at Annexure-D, as per their seniority, within a time frame. Mr.A.C.Dharmadhikari, the learned Counsel for the petitioners states that during pendency of the Writ Petition, an order is passed by the Collector stating therein that the claims of some of the petitioners and the other employees who are seeking similar relief would not be considered and the claim of only remaining employees would be considered for appointment.
If that be so, it would be necessary for the petitioners to file a fresh petition, if some of them who are not entitled to be considered for appointment are desirous of challenging the order of the Collector. So also, if they are not desirous of challenging the order, an amendment to the petition would be required and the same would be
219wp5024.17 2/2 extensive. The names of certain petitioners would be required to be deleted as they are not liable to be considered as per the order of the Collector. In view of the subsequent developments, we dispose of the Writ Petition with liberty to the petitioners to take up appropriate steps. Order accordingly. JUDGE JUDGE *jaiswal
