By consent, this application under Section 11(5) of the Arbitration and Conciliation Act (the Act), is disposed of with the following directions :

(i) Non-applicants shall appoint an Arbitrator from the panel maintained, since the applicant has waived the right under Section 12(5) of the Act.

(ii) The appointment of the Arbitrator shall be done within the next two weeks.

The applicant undertakes to withdraw the application under Section 14 of the Act, which is filed in the Court of Principal District Judge, Nagpur.

The Misc. Civil Application is disposed of.
