MISC. CIVIL APPLN. NO. 719 OF 2016 By this review application, the applicant/original respondent No.2 seeks the review of the judgment, dated 17/12/2015 in Writ Petition No.1912 of 2004 only in regard to the payment of the arrears of salary to the original petitioner for a period of three years prior to the date on which the writ petition was amended, i.e. 17/12/2015.
It is stated that the applicant is ready to fix the pay of the original petitioner in the proper pay scale from the beginning,
2/3 but the original petitioner would not be entitled to the monetary benefits for a period of more than three years before the writ petition was amended, on 17/12/2015.
Issue notice to the respondents on the review application only to the aforesaid limited extend, returnable on 12/08/2016.
Learned Assistant Government Pleader Shri A.A. Madiwale waives notice on behalf of respondent No.1. Additionally, the applicant is permitted to serve a copy of this miscellaneous civil application on Mrs.U.A.Patil, the learned counsel for the original petitioner.
In the circumstances of the case, presently we permit the applicant to proceed to pay the arrears of salary to the original petitioner for a period of three years preceding the date on which the writ petition was amended, on 17/12/2015, by fixing the pay scale.
