For reasons spelt out in the order dated 18-7-2019, this Court directed that applicant 1 shall remain present.

Several adjournments later, the directions were reiterated by the coordinate bench vide order dated 19-4-2022 which reads thus :

"1.

List the criminal application on 21st April, 2022 at 2.30 p.m.

2.

The applicants shall remain personally present on the said date."

The next order dated 21-4-2022 reads thus :

"We are informed by Mr. Shinde, learned advocate for the applicants, that the whereabouts of the applicants could not be traced and hence

2 apl 696.2019.odt they are not personally present in Court in terms of the earlier order dated 19.04.2022.

In such a view of the matter, the criminal application stands removed from the board."

In view of the observations above, we dismiss the application for want of prosecution with costs of Rs. 5,000/- (Rupees Five Thousand) to be deposited with the High Court Legal Services Sub-Committee, Nagpur. 6.

If any application for restoration is preferred, the Registry shall ensure that the direction to pay costs is duly complied with.
