Shri Samarth, the learned Counsel for the petitioner states that due to subsequent development, the cause for filing the writ petition has been rendered infructuous. It is, however, stated that a direction may be issued to the State Government to consider and decide the application filed by the petitioner for refund of the earnest deposit.
On the statement made by the learned Counsel for the petitioner, we dispose of the writ petition as infructuous. We, however, direct the respondent no.4 to decide the application filed by the petitioner for refund of earnest deposit as early as possible and positively within a period of four weeks. Order accordingly.
