The applicant - Salman Husen preferred Criminal Application (BA) 582/2020 seeking bail in Crime 439/2017 registered with the Tumsar Police Station for offences punishable under Sections 395, 398, 342 and 364 read with Section 34 of the Indian Penal Code, Section 3 read with 25 of the Arms and Section 135 of the Maharashtra Police Act.

This Court, vide order dated 16.10.2020 granted bail noting that there is no incriminating material to connect the applicant with the crime particularly since the complainant did not identify the applicant.

This Court directed that the applicant be released on bail on executing personal bond of Rs.25,000/- (Rupees Twenty-Five Thousand) with two solvent sureties.

Unfortunately, since last one year or thereabout, the applicant has continued to languish in custody apparently because he could not arrange for surety. 5.

The applicant who has approached this Court earlier. Be that as it may, the appointed counsel Mr. Gedam states that the applicant is ready to furnish cash surety of Rs.50,000/- (Rupees Fifty Thousand).

The condition that the applicant shall furnish two solvent sureties, incorporated in paragraph 10 of the order dated 16.10.2020, is deleted. Instead, it is directed that the applicant shall furnish cash surety of Rs.50,000/- (Rupees Fifty Thousand).

This application is allowed in the aforestated terms.
