By way of this application, the applicant is seeking condonation of delay of 913 days, which was caused in preferring the appeal against the conviction. The grounds raised in the application is that, being an illiterate person and in custody, was not aware of the legal provisions, and further due to financial crisis, he could not approach the counsel to prefer the appeal.

The appellant is convicted for the offence punishable under Sections 354-d, 323, 504, and 506 of the IPC and under Sections 7 and 8 of the Protection of Children from Sexual Offences (POCSO) Act, 2012.

Considering the reasons mentioned in the application, and being it is a statutory right of the applicant to prefer an appeal. Merely on the technical ground, which rkn

The appeal be registered.

On registration of appeal, learned APP waives service of notice on behalf of respondent/State 6.

Issue notice to the respondent No.2/victim on the application of suspension of sentence.
