It is expected that Shri G.G. Bade, learned Counsel who has filed power on behalf of the respondent sole would appear and assist this Court.

Shri Rahul Dhande, learned Counsel is requested to bring this order to the notice of the learned Counsel Shri G.G. Bade and learned Counsel Shri Sayyad Riyajuddin, who appeared on behalf of the respondent on previous occasion.

2] Shri Dhande, learned Counsel for the petitioners has placed on record a praecipe stating that he called the counsel for the respondent Mr. Sayyad Riyajuddin telephonically on 29.10.2018 and informed him that the matter is listed on 31.10.2018. The praecipe further states that the order dated 24.10.2018 is also forwarded to the counsel for the respondent on whatsapp.
3] However, despite the communication of the order dated 24.10.2018 neither Shri G.G. Bade nor Shri Sayyad Riyajuddin have appeared before this Court. 4] Since both the learned Counsels are not appearing, let notice be issued to the legal heir of the deceased respondent on the address which is available, although the address does not appear to be detailed. Civil Application (CAW) No.1733/2018:
For reasons stated in the application, the delay is condoned. The abatement is set aside.
2] Archana Suresh Hardikar be brought on record as legal representative of the deceased respondent Sharadkumar Prahlad Deoras. It would be open for Archana Suresh Hardikar to challenge her impleadment, if she deems fit.
