By way of present application for cancellation of bail, the State has prayed that bail granted to the nonapplicant/accused be cancelled, since he has breached the condition imposed by this Court (Coram : Anil S. Killor, J.) vide order dated 20.06.2022.

I have perused the record.

The non-applicant/accused was granted bail, in Crime No. 1018 of 2021 registered with police station Hinganghat, District Wardha for the offences punishable under Sections 307 and 504 of the Indian Penal Code, by this Court vide order dated 20.06.2022. The operative part of which reads as under:
"iii) The applicant shall not enter within the vicinity of Hinganghat till the completion of trial, except for the purposes of attendance in trial." 5.
The aforesaid condition would clearly reveal that the non-applicant was directed not to enter within the vicinity of Hinganghat till the completion of trial. However, immediately after the order dated 20.06.2022, a First Information Report No. 767 of 2022 dated 26.06.2022, for commission of offences punishable under Sections 323, 326 r/w. 34 and Sections 504 and 506 of the IPC, came to be registered against in all three accused. The non-applicant was shown as accused No. 3 in the said First Information Report. 6.
In First Information Report No. 767 of 2022 allegations were made that on 25.06.2022, accused Nos. 1 and 2, in the said crime, assaulted the informant and thereafter, the present non-applicant/accused No.3 came on his vehicle and took accused Nos. 1 and 2 with him. The incident had taken place in Hinganghat i.e. at Veer Bhagatsingh Ward.

From the aforesaid First Information Report it is crystal clear that the non-applicant has breached condition No.3 of order dated 20.06.2022. It is thus crystal clear that the non-applicant has no respect for law and therefore, the bail granted vide order dated 20.06.2022 deserves to be cancelled.

At this stage, learned counsel for the non-applicant/ accused submits that the non-applicant is behind the bar, but he is unable to give the details about the crime and the order. 9.
In that view of the matter, nothing is required to be taken into consideration so far as the defence advanced by the learned counsel for the non-applicant/accused is concerned. 10.
Accordingly, the application is allowed.

Bail granted by this Court vide order dated 20.06.2022 is hereby stands cancelled.

The criminal application stands disposed of, accordingly.
