The applicant herein has sought to condone the delay of 161 days in filing the appeal against the judgment dated 12-10-2017 in M.A.C.P. No.10/2016.

Learned Counsel for the respondent has opposed the application on the ground that no sufficient ground has been made out.

In view of the reasons stated in paragraph 4, which in my considered view constitute sufficient ground, the delay is condoned.

Appeal is ordered to be registered after removing office objections, if any.

Civil Application (F) No.51/2019 Heard.

The execution and implementation of the impugned judgment is stayed till next date, subject to deposit of the entire amount of compensation within a period of four weeks.
