Heard Shri Shaikh Sabahatullah-learned counsel for the applicant and Shri R.S. Nayak-learned Additional Public Prosecutor for the State.

This Court on 11th July, 2017 granted interim bail in favour of the applicant. At the same time, this Court directed the Investigating Officer to point out as to how the loan was sanctioned on Vidarbha Konkan Gramin Vikas Bank, Hingana Branch, MIDC Nagpur and Indian Overseas Bank, Hudkeshwar Branch, Nagpur. . Learned A.P.P upon instructions from the Investigating Officer as personally in the Court makes his statement across the bar that the applicant is in fact, the victim. Since he has purchased properties by obtaining loan from one Bank from the accused no. 2 Tulsiram Barapate and the bank has issued cheque indirectly in

2 ABA489.2017 favour of the Tulsiram Barapate, the applicant has not received anything.

According to the learned A.P.P., the custodial presence of the present applicant is not at all required by the Investigating Officer.

In view of the matter, following order is passed:-

O R D E R

1] The applicant Roshan S/o Shekhar Admane , in the event of his arrest in connection with Crime No. 186/2017 for the offences punishable under sections 420, 468, 471 read with Section 34 of IPC registered with Police Station MIDC Nagpur be released on bail on he executing a P.R. Bond of sum of Rs. 25,000/- with one solvent surety in the like amount.

2] The application is allowed and disposed of.
