After hearing the learned counsel for the parties, Shri R.D. Karode, learned counsel for the petitioner submits that the challenge to the impugned order passed below Exhibit 30 be kept open for being urged in case the original defendant is required to challenge the decree as passed by the trial Court. In view thereof, the challenge to the order passed by the trial Court on 11.07.2016 is not considered at this stage. The defendant is at liberty to challenge this order in appeal if occasion arises.

The Writ Petition is disposed of. No costs. The points raised are kept open.
