Heard.

Apprehending arrest in connection with crime registered for the offence punishable under Sections 65(e) and 83 of the Maharashtra Prohibition Act and Section 188 of the Indian Penal Code, the applicant seeks pre-arrest bail.

According to the investigating agency, on getting information, the police went to conduct raid at the spot, however, on seeing the police approaching the spot, the applicant fled but stock of liquor worth Rs.1,90,000/- is seized from the spot.

The application is opposed on the ground that the applicant is involved in similar crimes and is a habitual offender. It is argued that custodial interrogation of the applicant is required to find out

2 ABA490.17 whether other persons are involved in the commission of crime.

Considering the facts on record, following order is passed:

In the event of arrest in connection with Crime No.725/2017 registered by the non-applicant, the applicant be released on bail on furnishing cash security of Rs.1,00,000/- (Rs. One Lakh) and one solvent surety in the like amount.

The application is allowed in the above terms.
