The challenge raised in this Writ Petition is to the order passed by the Commissioner of Police, Nagpur whereby the performance license in favour of the petitioner has been cancelled. It is seen that against that order passed under Section 9 of the Maharashtra Prohibition of Obscene Dance In Hotels, Restaurants And Bar Rooms And Protection of Dignity of Women (Working Therein) Act, 2016, remedy of appeal under Section 10(1) of the said Act has been described. We do not find any reason to entertain the Writ Petition since statutory remedy is available to the petitioner. In view of aforesaid, the Writ Petition is not entertained. The petitioner is at liberty to challenge the impugned order dated 27/6/2022 by exhausting the statutory remedy. All points raised in the Writ Petition are kept open. The Writ Petition is disposed of.
