Heard learned counsel Shri N.A. Badar for the petitioner and learned Additional Public Prosecutor Shri S.S. Doifode for the respondents/State.

Without prejudice to his other contentions, learned counsel Shri N.A. Badar for the petitioner submits that if order of categorization is passed at the earliest, grievance of the petitioner may be redressed. Learned Additional Public Prosecutor Shri S.S. Doifode for the respondents/State fairly states that one of the authorities has recommended categorization under Category 1-B, while looking to the nature of offence, the other authorities have recommended categorization under Category 2-C of 2010 Guidelines. .....2/-

Learned counsel Shri N.A. Badar for the petitioner disputes this. According to him, 1978 Guidelines are applicable. We keep that contention open.

We direct the competent authority to pass final orders on categorization of the petitioner within a period of three months from today.

With these directions and keeping all rival contentions open, we dispose of the criminal writ petition. No costs.

Copy of this order be furnished to learned counsel for the parties to be act upon.
