DATE : November 29, 2017 Learned counsel for the non-applicant submits that in identical facts Criminal Application (APL) No.507/2016 was dismissed by this Court as per order dated 04/09/2017. The order impugned is passed by the Sessions Court remanding the proceedings for verifying the statement of the complainant.

Shri S. G. Karmarkar, learned counsel for the applicant does not dispute the fact that the challenge raised in the present application is similar to the challenge that was raised in Criminal Application (APL) No.507/2016.

Hence for reasons recorded in Criminal Application (APL) No.507/2016 this criminal application is also rejected.
