It is not in dispute that proceedings under Section 125 of Cr. P.C. and so also under the D.V. proceeding are pending at Akola, in which the nonapplicant is already appearing, considering which, in view of what has been held in D. Raja Rajeshwari Vs. R. Satish Kumar 2022 (2) SCC 329, Petition No.A 268/2020 pending on the file of Family Court, Yavatmal, instituted by the non-applicant, is hereby transferred to the Family Court at Akola.

The parties through counsel shall appear before the learned Family Court, Akola on 3.10.2022 and place a copy of this order before the learned Court, to apprise it of the same.

The parties through counsel shall appear before the learned Family Court, Yavatmal and place a copy of this order before the learned Court to apprise it

(2) 910.mca.413.2020 of the same, so as to enable it to transmit the record to the Family Court, Akola.

The application is accordingly allowed, in the above terms. No costs.
