By the present application, the applicant is seeking regular bail, since he is arrested and lodged in jail in connection with Crime No. 106/15 registered with Police Station, Ghatanji, Distt. Yavatmal, for offences punishable under Sections 326, 143, 148 and 504 of Indian Penal Code read with Section 135 of the Bombay Police Act and Sections 384, 332, 341, 353, 354, 395, 323, 427 and 325, IPC.

Heard Mr. P.S. Jaiswal, learned counsel for the applicant and Mr. A.D. Sonak, learned APP for the respondent State.

Learned APP has made available the entire
investigation papers.

The First Information Report is lodged by Babarao Ghatale. From the First Information Report, it is clear that the role attributed to the present applicant is like the role played by co-accused Nilesh Atmarao Chavhan. Further, the said Nilesh Atmaram Chavhan along with others had preferred an application before this Court and this Court on 25th August, 2015 has granted regular bail to said Nilesh and others. While considering the bail application filed by the co-accused persons in the said case, learned APP has made a statement that the entire investigation is over and only a formality of filing a charge-sheet remains to be done. The articles are already seized.

Looking to the fact that the investigation is over and only a formality of filing a charge-sheet remains to be completed, in my view, that is not a sufficient reason to curtail the personal liberty of the applicant. That leads me to pass the following order:-
O R D E R
[a] Criminal Application No. 547 of 2015 is allowed.
[b] The Applicant Vijay Kisanrao Kondalwar be released on bail on he executing a Personal
Bond in the sum of Rs. 25,000-00 [rupees twenty-five thousand only] with one solvent surety in the like amount in connection with Crime No. 106/15 registered with Police Station, Ghatanji, Distt. Yavatmal, for offences punishable under Sections 326, 143, 148 and 504 of Indian Penal Code read with Section 135 of the Bombay Police Act and Sections 384, 332, 341, 353, 354, 395, 323, 427 and 325, IPC.
[c] The applicant shall attend Police Station, Ghatanji, Distt. Yavatmal, twice a week, preferably on very Monday and Friday between 5.00 p.m. and 7.00 p.m., till the charge-sheet is filed.
The application is allowed and disposed of.
