The petition raises two questions: First is, to take action as per the Report dated 14.05.2015 submitted by the Deputy Director of Education, Amravati Division, in terms of the order dated 28.03.2018 issued by the Education Commissioner, Maharashtra State, Pune, seeking its compliance.

It is not in dispute that action has been taken and approvals of the persons named in the report have been cancelled, against which, those persons have already approached this Court by various writ petitions, and therefore, on account of this position, this plea has become infructuous.

The next plea is for a direction to the respondent Nos.1 to 4 to appoint an Administrator on the Management of Manora Education Society on the basis of a plea that there are only two surviving trustees, as indicated by the TAMBE

2 20 WP-4552-2021.odt entries in the Schedule - I. That is the plea, which cannot be entertained by the respondent Nos.1 to 4, and will have to be raised by the petitioner by filing appropriate proceedings before the Authorities under the Maharashtra Public Trusts Act, 1950.

In that view of the matter, the petition is dismissed with liberty to the petitioner to approach the Authorities under the Maharashtra Public Trusts Act.
