DATED : DECEMBER 7, 2018 This is an application for suspension of substantive jail sentence and for grant of bail. Mr.Sonwane, learned counsel appointed for applicant, in view of the subsequent events occurred in the matter, is not pressing this application. Hence, the application is disposed of as such.

Criminal Appeal No. 415/2018 By the present appeal, the appellant challenges the judgment and order of conviction passed by learned Additional Sessions Judge, Khamgaon in Sessions Trial No.10/2014 by which the appellant stands convicted for the offence punishable under Section 376

(2) (i) read with Section 511 and 452 of the Indian Penal Code. Thus the appellant was convicted for the attempt to commit rape and on that ground the appellant was directed to suffer rigorous imprisonment for 5 years. During the trial, the appellant was arrested

apeal415.18.odt on 19.11.2013 and he was under trial when he was under trial prisoner, Sessions Trial No.10/2014 was decided by the impugned judgment.

This Court on 27.06.2018 admitted the present appeal.

Today, Mr. Joshi, learned A.P.P. makes a statement on instructions that after completion of 5 years of the sentence, the appellant is released from jail permanently.

The statement is accepted.

In that view of the matter, the present appeal is disposed of.

Professional charges of Mr. D. A. Sonwane, learned counsel for appellant appointed through High Court Legal Services Sub Committee, Nagpur are quantified at Rs.2500/-.
