Heard. Considering the limited relief sought, Rule is made returnable forthwith. Learned Assistant Government Pleader waives notice for respondent No.1 and Shri B. G. Kulkarni, learned counsel waives notice for respondent No.2. 2.

The petitioner sought permission for starting a new College under the purview of respondent No.2-University and submitted its proposal on 05/11/2022 after following the prescribed procedure and in accordance with the prescribed conditions. The respondent No.2-University on 04/01/2023 granted its consent to the said proposal for starting the new College from the academic session 2023-2024 with regard to four courses. The said proposal is stated to be pending with the State Government-respondent No.1. The petitioner seeks expeditious

24-WP-4528-23.odt 2/2 consideration of the said proposal dated 05/11/2022 by the Department of Higher and Technical Education. 3.

In these facts, the respondent No.1 is directed to consider the proposal dated 05/11/2022 in the matter of grant of permission to the petitioner for starting Senior College at Nerpinglai, Taluka Morshi, District Amravati as consented by respondent No.2University on 04/01/2023. Necessary decision be taken within a period of eight weeks from receipt of copy of this order. The decision shall be taken in accordance with law and same shall be communicated to the petitioner and respondent No.2. The said permission, if granted, would be from the academic year 20242025 since the academic session 2023-2024 has already commenced.

Rule is made absolute in aforesaid terms with no order as to costs.
