Heard Shri P.A.Kadu, learned advocate for the petitioners and Shri A.M. Deshpande, learned A.G.P. for the respondent No.2.
The petitioners/ employer take exception to the order passed by the Labour Court on the preliminary issue regarding the legality and fairness of the enquiry. Considering the law laid down by the Hon'ble Supreme Court in the judgment given in the case of D.P. Maheshwari Vs. Delhi Administration, reported in (1983) 4 SCC 293, I am not inclined to interfere with the impugned order at this stage. Needless to say that the petitioners would be at liberty to raise appropriate challenge to the impugned order in appropriate proceedings, if occasion arises. The petition is disposed of accordingly.
