The submission of the learned counsel for the petitioner Dr. Renuka Sirpurkar is that the issue is covered by the decision of the Coordinate Bench in Writ Petition 3798/2018 Smt. Manisha Mahadeo Gedam v. Zilla Parishad, Gadchiroli and ors.

The learned counsel for respondents 1 to 4 Mrs. Giratkar fairly agrees that the issue is covered as submitted by Dr. Sirpurkar.

For reasons recorded by the Coordinate Bench in the judgment dated 06.05.2022 in Writ Petition 3798/2018, we allow the petition in terms of prayer clause 1 and 2 which read thus:

1) quash and set aside the impugned order of suspension dated 27.6.2018

2) be pleased to declare the communication dated 17.4.2018 Annexure-II, issued by the respondent no.5 Section Officer, Maharashtra State, Mumbai as being arbitrary and illegal;

In view of the relief granted, the petitioner shall be entitled to every consequential benefit to which the petitioner is entitled in law.
