As the amount of compensation is deposited, the execution of the impugned award shall remain stayed during pendency of the appeal.

Civil application is disposed of.

C.A.O. NO. 324/2019.

Prayer is to permit the claimants to withdraw the amount of compensation as deposited.

Perused the impugned judgment. Considering the nature of evidence on record, the claimants are permitted to withdraw an amount of Rupees Seven Lakhs from the amount of compensation as deposited. The respondent nos.1 and 2 would be entitled to receive an amount of Rupees Five Lakhs while the respondent nos.3 and 4 would be entitled to receive amount of Rupees One Lakh each.

Respondent nos.1, 3 and 4 shall file an undertaking in this Court within eight weeks that in case the appeal is allowed, the amount withdrawn will be re-deposited along with interest at such rate the Court may deem fit. Rest of the amount shall remain invested in Fixed deposit.
