After hearing for sometime, I am of the opinion that as the respondent No.2 has already joined in place of the petitioner, instead of entering into the merits of the matter, it would be appropriate to direct the Industrial Court to decide the complaint within one month, which will sub-serve the ends of justice.

The learned counsel for the petitioner further points out that the petitioner has made representation to the Block Development Officer for considering her case for transferring her at at a nearby place of Salona, wherefrom she was transferred to Katkumbh. It is submitted that the said representation is pending with the Block Development Officer.

In the circumstances, I pass the following order: i) The Industrial Court is directed to decide the Complaint (ULP) No.67 of 2023, within one month from the date of appearance of the parties and the transfer of the petitioner and respondent No.3 would be subject to result of the complaint.

ii) The Block Development Officer is directed to take a decision on the representation of the petitioner, if any, pending before him for considering the case of the petitioner sympathetically, within fifteen days from today. The Writ Petition is disposed of accordingly. No order as to costs.
