After hearing learned Counsel for both the sides for some time, both the learned counsels, on instructions, make a statement that the order impugned passed by the Deputy Commissioner, Amravati be set aside and the complaint made by respondent no.4 be relegated back to CEO for its decision on merit.

In view of the above, the impugned order is set aside. The complaint of respondent no.4 is relegated back to CEO for its decision in accordance with the law. CEO is expected to pass order after giving reasonable opportunity of hearing to both the sides and on considering the relevant material placed before him by either side.

Since the post of 'Anganwadi Sewika' is vacant for last six years, the CEO is directed to decide the complaint/representation of respondent no.4 within a period of two months. Till the decision of CEO, interim relief granted by this Court to continue.
