Date : 20 th April, 2017 The Family Court passed a decree for dissolution of marriage in H.M.P. No.A-627/2005. It was an ex parte decree and the application, i.e. M.J.C. No.24 of 2007, filed under Order IX, Rule 13 of the Code of Civil Procedure for setting aside the ex parte decree was allowed by the Family Court on 29-6-2009, which is the subject-matter of challenge in this petition.

This Court, while issuing notice on 19-11-2009, stayed the further proceedings of Petition No.A-627/2005, and after hearing the parties concerned, the interim order was confirmed on 29-9-2010 and the matter was admitted.

None appears for the parties.

After going through the order impugned, I do not find any

2004wp4269.09.odt reason to interfere in it. The petition is dismissed. The Family Court is directed to proceed further to decide the petition within a period of six months from the date of first appearance of the parties before it.
