Having considered the reasons given in the impugned judgment and order, I am of the view that the instant Application can be conditionally allowed. The respondent no.1/claimant is allowed to withdraw 25% of the total amount deposited by appellant on furnishing usual undertaking before Registrar (Judicial) of this Court, within four weeks from the date of this order. The remaining amount shall be deposited in fixed deposit of any nationalised Bank initially for a period of three years. With this direction, the Civil Application is allowed accordingly and disposed of.
