Shri Khubalkar, the learned Assistant Government Pleader appearing on behalf of the respondent nos.1 and 3, raises a preliminary objection to the tenability of the writ petition. It is stated that the petitioner has an efficacious alternate remedy to challenge the impugned order under Rule 14 of the Maharashtra Zilla Parishad District Service (Discipline and Appeal) Rules, 1964. It is stated that the petitioner has rushed to this Court without availing the alternate remedy.

We uphold the preliminary objection raised on behalf of the State Government and decline to entertain the writ petition. The writ petition is disposed of with no order as to costs. The points raised in the petition are kept open. JUDGE JUDGE APTE
