Masurke, Advocate for the petitioner. CORAM : Z.A. HAQ, J.

DATED : 18.7.2019.

Ms. Kalyani Deshpande, learned A.G.P.

appearing for respondent No.3 pointed out that revision under Section 154 of the Maharashtra Co-operative Societies Act, 1960 lies against the impugned order. Learned Advocate for the petitioner submitted that looking to the facts of the case and the controversy involved in the matter, grievance of the petitioner is required to be examined by this Court in extra-ordinary jurisdiction and the petitioner need not be relegated to the alternate remedy.

I expressed that the petition cannot be entertained directly unless alternate remedy is exhausted.

In view of the above, learned Advocate for the petitioner sought permission to withdraw the petition

2 wp4888.19 with liberty to avail the alternate remedy. Petition is disposed as withdrawn with liberty as prayed for. No costs.

JUDGE Tambaskar.
