By this application, the applicant seeks a recall of the order, dated 28.04.2016, as according to the applicant, the statement as is recorded in the order dated 28.04.2016 was not made in the writ petition bearing Writ Petition No.1004 of 2016, but such a statement was made in Writ Petition No.25 of 2016. It is stated that that mistakenly same order was passed in both the writ petitions.

Shri J. B. Kasat, the learned counsel for the respondent Nos.2 and 3, admits the statements made on behalf of the applicant. It is stated that this Court had directed the issuance of 'Rule' in Writ Petition No.1004 of 2016.

Hence, we recall the order, dated 28.04.2016 and issue RULE.

Learned Assistant Government Pleader Shri Ambarish Joshi waives notice of hearing on behalf of respondent No.1. Learned counsel Shri J. B. Kasat waives notice of hearing on behalf of respondent Nos.2 and 3.
