DATED : 13 AUGUST, 2015 The application is filed by the appellant for permission to withdraw the amount deposited in this Court by crossobjector/respondent No.3. Taking into consideration the reasoning given by the learned Reference Court, we are inclined to allow the application partly. The appellant is permitted to withdraw 50% of the compensation amount deposited by respondent No.3 on the appellant's filing an undertaking that in the event if this Court direct the appellant to refund any amount, the appellant shall do so. Remaining amount shall be invested in the fixed deposit in any nationalized Bank initially for a period of five years and thereafter renewed from time to time.
