Ms. N.P. Mehta, learned Additional Government Pleader has put an appearance and waives service of notice for respondent Nos.2 and 3. She has pointed out that in view of the provisions contained in Section 33(5) of the Maharashtra Village Panchayats Act, 1959, this petition will not be maintainable for the reason that the said provision provides for a statutory remedy in the event of dispute arising as to the validity of the election of Sarpanch. 2.

Learned Counsel for the petitioner prays that he may be permitted to withdraw the petition.
