JUDGMENT

(PER : A.S. CHANDURKAR, J.) RULE. Rule made returnable forthwith and heard the learned counsel for the parties.

WP 6110-19 Judgment 2.

The petitioner seeks release of retiral benefits from Municipal Council, Bhandara pursuant to the services rendered by her with the said Municipal Council.

The learned counsel for the petitioner as well as the learned counsel for the Municipal Council agree that similar writ petitions seeking identical relief have been allowed. Reference is made to the judgments in Writ Petition Nos.163 of 2018 and 165 of 2018 [Dattatraya Gujabrao Wankhede Versus State of Maharashtra & Others AND Ramesh Baliram Sawalakhe Versus State of Maharashtra & Others] dated 24.07.2019. 4.

Considering the aforesaid and by adopting the reasons mentioned therein, the following order is passed: Respondent No.4 is directed to release all the retiral benefits payable to the petitioner within four months from the date of the judgment together with interest calculated in terms of Rule 129(A) and (B) of the Maharashtra Civil Services (Pension) Rules, 1982. 5.
