DATED : 28-10-2021 The applicant is seeking bail in connection with Crime 376/2021 registered with Police Station, Kapilnagar, Nagpur for offences punishable under Sections 307 and 323 read with Section 34 of the Indian Penal Code (IPC).

The report dated 8-9-2021 on the basis of which the crime is registered, is lodged by legally wedded wife of the applicant.

The prosecution case is that the legally wedded wife and the 8 years old daughter reside on the first floor of the house and the applicant and the female co-accused reside on the ground floor.

It is alleged that due to the extra marital relationship, the applicant and the co-accused have, on several occasions, physically assaulted the complainant and the daughter. On the fateful day, apart from physically assaulting the complainant, the accused made an attempt to kill her by setting afire her saree. The
2 ba 1066.2021 investigation is ongoing, while the learned counsel for the applicant did submit that the complainant did not suffer any injury, the medical papers bely the submission. The complainant has suffered facial injuries and burn, albeit superficial.

The applicant is already facing several prosecutions. The crime chart in the case diary reveals that from 2016 to 2019, as many as 10 offences are registered against the applicant which include offence punishable under Section 302 of the IPC.

Considering the formidable material on record to connect the applicant with the crime, criminal antecedents and the possibility that the applicant shall pressurize the witnesses, I am not inclined to grant bail. 7.
The application is dismissed.
